Codification of Private International law - Balance and Outlooks
Project goals
The project is based on three phenomena which significantly characterise in opinion of the applicant the present era: first, re-codification of the Czech Private Law including Private International Law, further, a general trend of Private InternationalLaw, which may be characterized as a development from the original national regulations of Private International Law towards the unification, and, finally, the existence of European Private International Law which greatly affects the universal development of this branch and is one of the most dynamically developing areas of private law within the EC. This important part of European Law requires continuous commentaries, critical assessment and systematic treatment. Necessary seems to be also a confrontation. Namely, in parallel, codifications in some EU Member States are developing, which is also the case of Czech law. The project will be devoted to two spheres: 1. questions of codification of Private International Law within the EC, 2.

Navrhovaný projekt vychází ze tří fenoménů, které jsou podle názoru navrhovatelky charakteristické pro dnešní dobu: předně, rekodifikace českého soukromého práva včetně mezinárodního práva soukromého, dále, obecný trend mezinárodního práva soukromého, který lze charakterizovat jako vývoj od původních národních úprav mezinárodního práva soukromého v jednotlivých státech směrem k unifikaci, a konečně, třetím fenoménem je existence evropského mezinárodního práva soukromého, které výrazně poznamenává univerzální vývoj tohoto oboru a bývá považováno za jednu z nejdynamičtěji se rozvíjejících oblastí soukromého práva v rámci ES. Tato významná oblast evropského práva vyžaduje průběžné komentáře, kritické posouzení a systematické zpracování. Nezbytná je i určitá konfrontace. V úrovni členských států EU se totiž paralelně nadále rozvíjejí národní kodifikované úpravy, což je i případ českého práva.
