The Key Concepts of Constitutional Theory in the Age of Changes of Paradigms
Project goals
German political and legal theorist C. Schmitt considered the key concepts of constitutional theory to be meaningly connected with the changing social conditions. It is therefore possible that the same expressions are used in a long term but in a considerably different meaning. Examples might be classical concepts like sovereignty, separation of powers, democracy, or constitutionalism. The theme of an analysis in numerous articles and at least two monographs, including one foreign, shall be a confrontation of classically anchored concepts and institutes with the conditions of 21st century, where there is referred to a changing function and nature of the state (and particular branches of state power) and law (concepts of legal and constitutional pluralism and polycentrism). Does there remain for example any core of meaning of the concept of sovereignty? These questions are rather practical as it demonstrated, e. g., by the controversies regarding the decisions of constitutional courts related to European law or constituent power, which should be a focus of our research.

Klíčové pojmy ústavní teorie v čase paradigmatických změn

Význačný, ač kontroverzní německý politický a právní teoretik C. Schmitt považoval klíčové pojmy ústavní teorie za významově svázané s měnícími se sociálními podmínkami; mluvil o sociologii právních pojmů. Je tudíž možné, že sice dlouhodobě užíváme stejných výrazů, avšak ve značně odlišných významech. Příkladem mohou být klasické pojmy jako suverenita, legitimita, dělba moci, demokracie, konstitucionalismus, ale i ústava. Předmětem analýzy v řadě článků a v nejméně dvou monografiích, z toho jedné zahraniční, by měla být konfrontace klasicky ukotvených pojmů a institutů s podmínkami 21. století, v němž bývá poukazováno na změnu funkcí i povahy státu (a jednotlivých větví státní moci) a práva (koncepty právního a ústavního pluralismu a polycentrismu). Zůstává např. vůbec zachováno nějaké významové jádro toho, co znamená suverenita, nebo jde ve srovnání 19. a 21. století o "suverenity" jiné? Otázky jsou to značně praktické, jak ukazují mj. kontroverze ohledně rozhodnutí ústavních soudů ve vztahu k evropskému právu či ústavodárné moci, která by měla být v centru našeho výzkumu.

The project fulfilled the expectations and its impact is very deep. With support of this project were published 4 monographs and many articles. Total number of outputs entering the RIV database is over twenty. The research team dealt with the planned topics. As the "side effect" of the project is very important to mention close cooperation with students of the doctoral programme.
