Legal status of national minorities in the past and present
Project goals
This project is about to present the legal status of national minorities in the CR in the past and present in comparison with other Central European countries. Legal amendments to minority question are passed relatively continuously and these long-term trends in minority question should be described. The historical development mainly after 1968 will be studied, focusing also on current legal amendments passed after 1989. As for current law, attention will be paid to its influence on individual minorities, discussions of "de lege ferenda" and also on other theoretical and practical questions. The influence of international law cannot be neglected in this case, namely the European system of human rights protection. A team of research workers from the Faculty of Law Prague intends to organize at least 2 workshops, to compile this topic in individual studies and in a final extensive publication. Achieved knowledge could be used in science, university education and legislative process.

Právní postavení národnostních menšin v minulosti a současnosti

Projekt se má věnovat právnímu postavení národnostních menšin v minulosti a současnosti v ČR ve srovnání s dalšími zejména středoevropskými zeměmi. Právní úprava menšinové otázky se vyvíjí poměrně kontinuálně a mají být prozkoumány tyto dlouhodobé tendence. Historický vývoj bude studován hlavně po roce 1968 včetně vytváření současné právní úpravy po roce 1989. U platného práva bude zájem věnován působení na jednotlivé menšiny, diskusím de lege ferenda i dalším problémům teorie a praxe. Nebude opomenut vliv mezinárodního práva ? zejména evropského systému ochrany lidských práv. Kolektiv badatelů zejména z Právnické fakulty UK míní zorganizovat nejméně dva workshopy, zpracovat problém v dílčích studiích i závěrečné rozsáhlé publikaci a umožnit využívánídosažených poznatků o často aktuální problematice ve vědě, vysokoškolské výuce i legislativní praxi.
