    Protection of Personal Rights in the Czech New Civil Code

  • Original language description

    The New Civil Code is based on the principles arising out of the ius naturalis approach. The natural rights are protected under the Czech Charter of fundamental rights and basic freedoms. Demonstratively, the main principle is that everyone has the rightto protect his life and health, as well as freedom, honour, dignity and privacy. In comparison to the previous Civil Code, Act No. 40/1964 Coll., the NCC in respect of personal right, does not constitute diversion from the basis of protection.
