The authors analyse the Union of the proceeding before European commission regarding State Aid. The beneficiary, who may be affected party, has practically no procedural rights. This is an evident violence of the Charter of fundamental rights of EU and the European convention on human rights, especially Artt. 6. The article is a pleadoyer for a change of the procedure regulation No 659/1999.
