The European Union as a Community sui generis
Original language description
The discussion of the nature of the Union as a whole, or if we want, a state sui generis, is far from having been exhausted. Discussions on the elements of statehood of international organisations began at the time of their formation. The question repeatedly arises as to the definition of the Union as an entity sui generis. Since the Lisbon Treaty came into effect the Union as a whole has had a separate legal personality; similar to that of any other state but different because it is not a state. The definition of the statehood of an international organisation developed in relation to the inter-war League of Nations. Some thought that it was a utopia of a future society based on principles of humanity, mutual friendship between nations, and respect for the independence and territorial integrity of states. An international organisation based on high ideas and morals. Although the European Union is different, it is something completely new, and the general questions concerning its nature and statehood have yet to be resolved.
