    Current Debates on Medical Liability in the Czech Republic

    The Czech Republic has undergone a rather rapid development in health law over the last twenty years. After the Velvet Revolution at the end of 1989, the country started to open to the new trends coming from anthropocentrism. For health care, the crucial change came with the ratification of the Convention on Human Rights and Biomedicine in 2001. The paternalistic ambiance of the Czech health care system had to transform into a more patient-oriented paradigm based on the patient&apos;s autonomy of will and informed consent. . The health law reform peaked in 2011 with the enactment of three crucial laws, especially in the Act No. 372/2011 Coll., on Health Services, and was confirmed in the No. 89/2012 Coll., the Civil Code (hereinafter &quot;Civil Code&quot;). In the area of tort law, the Civil Code brought about several important changes which also apply to medical malpractice disputes and which are currently discussed in the Czech Republic.
