Whither the future of international nuclear law? A survey in legal futurism
Original language description
What will be the future of international nuclear law? Th e existing scholarship on legal futurism argues that the future of law can be modelled, if analysing the longterm existing trends in the respective area. Th is article aims to apply this thesis vis-á-vis the special (sub)discipline of International Public Law, governing peaceful uses of nuclear energy. It argues that future developments of international nuclear law will mainly occur through new regional or bilateral agreements, or by adopting new instruments of soft law. Further, the article claims that one can more probably await the use of fl exible mechanisms in existing international agreements that adopt new agreements in this fi eld. Finally, the article will identify determinants that limit to a certain extent any predictions of further developments in this field.
