The chapter explains the concept of justiciability of human rights. It discusses which arguments are put forward to support non-justiciability of ESCR and how these arguments have been countered. It then gives an overview of the domestic and international practice related to the justiciability of ESCR. This overview, together with the summary of the doctrinal debate, reveals the trend to see all human rights as (at least partly) justiciable.
