Original language description
The paper seeks to identify, outline and discuss certain legal and occasionally other dilemmas that pertain to the prosecution of the crime of aggression. It does so in light of the proposal to establish a Special Tribunal for the Crime of Aggression. The dilemmas are described in the form of questions that anyone considering how to prosecute the crime of aggression committed against Ukraine (or, potentially, against any other country) needs to address. The dilemmas pertain inter alia to the type of judicial organ carrying out the prosecution, the definition of the crime of aggression, the circle of potential defendants and certain procedural and other obstacles to the prosecution. The discussion of these questions is preceded by a section in which yet another dilemma, namely whether to prosecute the crime of aggression at all, is presented.
