Force Majeure: An Exploded View
Original language description
This paper provides a critical examination of how pleas of force majeure have operated in international cases comprising both inter-state litigation and foreign investment disputes. The manuscript takes the reader through selected international disputes, listed in chronological order, followed by a paragraph summarising the conclusions arising from the material examined by the two authors. The conclusion aim to supplement, not to replace, the generally accepted definition of vis major in international law by outlining an "exploded view" of its workings in the practice of international tribunals.
