Administrative contract in Czech Law from the Perspective of Comparative Analysis
Original language description
The administrative contract is a relative novelty in the Czech legal system. Although it was de facto used in the period before World War II, its legal regulation did not exist. The change occurred only with the adoption of the new Act on Administrative Procedure. The Czech regulation to a certain extent copies the German regulation, and also takes into account the development in the French legal system, where this contract has a significant tradition. The subject of the contribution is the practice of the Supreme Administrative Court of the Czech Republic and, in particular, the legal regulation itself, which does not allow the application of the Civil Code in cases where there is a gap in the law.
