Assessing the Legal Boundaries of Military Support to Ukraine from the Perspective of Use of Force
Original language description
Military support provided by states to Ukraine in its armed conflict with Russia sparked debates about its compliance with international law. While ius contra bellum allows third states to use force in collective self-defence, none of the Ukraine supporting states have reported to the UNSC. Proclamations of these states have even avoided using terminology of ius contra bellum. The ICJ has however already stated in the context of one state arming and training of a non-state actor in another state that such support may qualify as use of force. Transferability of this conclusion to the context of an IAC is controversial though. Using the example of Russia-Ukraine war, the article analyses whether military support provided by state(s) to one of the parties of an IAC may establish use of force against the adversary-state of the supported one by the supporter and continues by assessing the possible ius contra bellum-based justifications.
