    This case note examines the Grand Chamber judgment of the Court of Justice of the European Union (CJEU) in Case C-115/22, NADA and Others, marking the first preliminary reference made by a sports arbitration body. The case concerned the compatibility of Austria&apos;s mandatory public disclosure of anti-doping sanctions with the General Data Protection Regulation (GDPR). The CJEU declared the request inadmissible, holding that the Austrian Independent Arbitration Committee (USK) lacked sufficient independence to qualify as a &quot;court or tribunal&quot; under Article 267 TFEU. This judgment reflects a broader recalibration of the CJEU&apos;s independence standards in light of the EU&apos;s rule of law crisis, particularly the irremovability requirement. Beyond the procedural dimension, the case reopens debates on whether anti-doping rules fall within the scope of EU law. Contrary to the Advocate General&apos;s view, this note argues that anti-doping rules-given their economic implications-engage the GDPR. The CJEU&apos;s evolving scrutiny of sports arbitration, as evidenced by ISU v Commission and Royal Football Club Seraing, affirms the need for national courts to ensure such arbitration complies with EU law.
