Proportionality, human rights, and the World Anti-Doping Code
Original language description
The principles of proportionality and human rights play an essential role within and beyond the World Anti-Doping Code (WADC). Compliance with these principles is a condition for the autonomy of the World Anti-Doping Agency (WADA) and other anti-doping organisations to enact, accept and implement the WADC and to fight against doping. The WADC refers to these principles in both its text and application. Moreover, anti-doping rules and decisions must conform to national and international proportionality standards and human rights. In particular, the European Court of Human Rights (ECtHR) ruled that anti-doping rules must conform to the European Convention on Human Rights (ECHR), especially the criterion of proportionality. While the WADA and some authors consider that the WADC complies with the principles of proportionality and human rights, other authors are critical and call for a more proportionate and human rights-friendly approach in the fight against doping.
