We live in an era of artificial intelligence development, in which there is no longer any debate about whether judges' decisions will be replaced by artificial intelligence, but rather only about when and to what extent. It is precisely at this time that there is a growing need to draw attention to the constitutional limits of implementing AI in decision-making processes.Artificial intelligence already has its place in decision-making processes. Countries are increasingly introducing AI algorithms for decision-making in the judiciary. The growing importance of AI is evidenced, for example, by the fact that a judge consulted artificial intelligence instead of his own judgment when assessing criminality. This, of course, brings advantages, particularly speed and efficiency, but also risks, including possible systemic errors and a lack of the human element. This paper will focus on the consequences of deploying algorithmic systems in court decision-making in the context of the right to a fair trial. I will address the question of whether and how AI interferes with the right to a fair trial. The aim of the paper is to assess the extent to which the use of AI tools in the judiciary is compatible with the fundamental right to a fair trial.
