Some typical examples of merger-related abuse of intellectual property rights are described and basic methods of assessing mergers are compared, namely the market dominance test, the test of substantial lessening of competition and the test of productivity growth standard. The suspicion is expressed that short-term productive efficiency is now mostly preferred to long-term innovative efficiency. The more conservative and less productivity-growth oriented approach seems to prevail. The conclusion pleadsfor a more lenient assessment of mergers in high-technology industries compared to industries that have entered their stable phase.

Jsou popsány typické případy zneužití duševního vlastnictví prostřednictvím fúzí a základní metody hodnocení fúzí. Kritizuje se krátkodobě orientované posuzování efektivnosti v neprospěch dlouhodobé a dynamické (inovativní) efektivnosti. V technologickyvyspělých odvětvích by se fúze měly posuzovat mírněji než v klasických stabilizovaných odvětvích.
