Paper deals with the paradoxes of the current state and the new trends of unfair competition law in the EU and in the Czech Republic. Unfair competition is the subject matter of the recently adopted Directive of the European Parliament and the Council No. 2005/29/EC of 11 May 2005 concerning unfair business-to-consumer commercial practices. The author proposed the ways of its transposition into the national legal system.

Czech description
Práce se zabývá novými trendy v evropském právu proti nekalé soutěži, jak je vyjadřuje mimo jiné Směrnice 2005/29/ES a jak byly již promítnuty do nového německého zákona proti nekalé soutěži. Shrnuje úvahy i z dalších evropských států o možné změně právaproti nekalé soutěži. Uvádí možnosti nové úpravy této oblasti práva v českém právním řádu. Zabývá se i aktuálním problémem transpozice Směrnice 2005/29/ES do českého práva.
