Institution of Asylum in the Czech Republic in Light of EU Legislation
Original language description
The objective of the article was to discuss the process of implementation of European asylum legislation into the legal order of the Czech Republic in the form of stipulation of the institution of international protection. It can be stated in this respect that the quality of the regulation of asylum legislation can be described as euroconform, i.e. meeting the harmonisation objectives. It was found that an important role in interpretation of the Asylum Act in the context of the EU law and the related case-law of the European Court of Human Rights is played by the Supreme Administrative Court, namely within proceedings concerning cassation complaints, and the Supreme Administrative Court represents one of the control mechanisms of the decision-making process performed by administrative bodies.
