Terminology of Roman Criminal Law crimen et delictum
Original language description
The present article analyses the terminology of Roman criminal law that can be systematically found both in private law ius privatum and in public law ius publicum. The paper focuses on basic terminology that differentiates criminal private law and criminal public law. Delictum et crimen are the aforementioned terms. On the basis of chosen provisions from libri terribiles, The Institutes of Gaius and Justinian, an exegesis was done and these fragments were interpreted from the point of view of their systematic ordering, used terms and kinds of sanctions.
