This paper is dedicated to the regulation of the new insolvency proceedings in the Czech Republic with considerable focus on the rehabilitating resolution of the insolvency for the non-entrepreneurs that has been established by the Act no. 182/2006 Coll., on insolvency and its resolutions (the Insolvency Act, herein after IA). The core part of the contribution is formed by the analysis of the discharge from debts that is a special resolution for the insolvent debtor without debts resulting from entrepreneurial activities. This resolution could be considered as a revolutionary because it gives an opportunity to save the natural person from the debt-trap and to help him to stabilize his personal financial balance. In this context the contribution particularly deals with the prerequisites for the discharge from debts and also with the associated part of the insolvency proceedings presumed by the IA.
