The conclusion of contracts is stipulated in the Commercial Code in Sections 269 to 275 under the heading Some Provisions on the Conclusion of Contracts, from which it clearly follows that we can find only a part of the regulation in the Commercial Code.The basis of the regulation consists in Sections 43 to 51 of the Civil Code and commercial contractual relationships are subject to what is otherwise stipulated in Sections 269 to 275 of the Commercial Code. In commercial contractual relationships, theparties may use a type of contract indicated in the Commercial Code (for example, to conclude a purchase contract whose subject consists in goods, contract on sale of enterprise, contract for work, etc.), use a type of contract from the Civil Code (see Section 261 (6) of the Commercial Code) in case that the Commercial Code does not contain that type of contract (e.g. contract of mandate, purchase contract for real estate, general lease contract, etc.
