The aim of this paper is to analyse public policy under the Article V(2)(b) of the New York Convention as an instrument protecting the right to a fair trial. The core part of the paper is based on the analysis of selected case law of national courts applying the New York Convention. First, the concept of public policy under Article the V(2)(b) and the principles of its interpretation are analysed in general. In this part, the standard of international public policy is explained. The standard of international public policy does not represent an international or supranational standard. It is still the standard based on national law which is applicable to foreign arbitral awards. Secondly, the right to a fair trial within the context of public policy is assessed. This part is mainly based on the selected case law of national courts. Concerning the right to a fair trial, most of the courts use the standard of international public policy. The national courts generally acknowledge that the right to an independent and impartial arbitrator as well as the right to present one’s case (with the exception of the lack of reasoning in the award) form part of (international) public policy within the meaning of the Article V(2)(b). However, the threshold for finding the violation of (international) public policy is high.
