Online Cross-Border (Consumer) Contracts from the Point of View of the Case-law of the Court of Justice of the EU

  • Original language description

This article analyses case law of the Court of Justice of the EU concerning online contracts, online consumer contracts in particular. The number of contracts concluded via electronic means is rising. Especially online consumer contracts are a reality of everyday life. Nowadays, it is relatively easy to conclude contract with international element. These contracts and their terms and conditions very often contain prorogation clauses and/or choice-of-law clauses. The aim of this article is to analyse the relevant European regulations, namely Rome I Regulation and Brussels Ibis Regulation in the context of online (consumer) contracts. This analysis will be based on the case law of the Court of Justice of the EU. POZNÁMKA: Sborník z konference bude zaslán k zařazení do databáze Scopus v roce 2017/2018.
