The author comments on the judgement of the Supreme Court from May 2016, which deals with the issue of the legal status of the certificate of serviceability of the gaming machine from the point of view of criminal law. Firstly, the author analyses the legal regulation of the authentic instrument and then deals with the issue of whether the certificate could be an authentic instrument, even though it is not the final decision of the public authority to authorize the serviceability of a gaming machine.
