The chapter is focused on a question of further development of the European Union. The question is what possibilities Member States and the authorities of the European Union have under current situation. In particular, the current active and extensive approach to the interpreting of the scope of EU competences is questioned, particularly in the case of Article 114 TFEU. The chapter calls for an a alternative interpretation to this provision which will be based on an evolutionary (not evolutive) approach to law.
