  • Original language description

    The consumer protection policy of the European Union sets the baseline for developing national regulation. It follows the objective of promoting consumer interests and ensuring a high level of consumer protection. The Consumer Rights Directive 2011/83/EU regulates key issues in the area of distance contracts, i.e. contracts negotiated outside of the business area. However, several shortcomings were identified in the transposition of Directive 2011/83/EU into Czech private law. For this reason, the Civil Code should be amended. This paper examines the baseline of consumer protection under the Directive, highlights the transposition shortcomings and brings to light the practical impact of these shortcomings. It will also answer the question whether the amendment complies with the requirements of the Directive and whether the rules contained in the Directive are sufficient.
