Mediation in the Perspective of Law and Social Change
Original language description
Mediation cannot be understood without its social, cultural and legal context. Therefore, the authors place the topic of mediation within theoretical and legal concepts such as cultural systems, justice and legitimacy, trust in law and others, and subsequently focus on the topic of law and social change. The authors define the interrelationship between mediation, which is part of the legal system, and society as a whole. Law is defined by the authors as an institution of society and part of its sociocultural system. Law is one of the most important instruments of social control in late modern society. At the same time, law acts as a symbol of justice and is associated with the idea of fair law and fair decision-making. In order to achieve this goal, it is necessary to have trust in law, as well as in the alternative means of dispute resolution.
