Prospects for the Development of Mediation in the EU
Original language description
The book concludes with this chapter, which aims to outline the prospects for the further development of mediation in the European Union. The chapter is mainly based on the interweaving of the theoretical analysis of the systems of approach to mediation (Part III) and the results from a spatiotemporal analysis of the rate of mediation use in individual EU countries (Part IV), which is examined especially in relation to the mediation success rate. Although we are aware that the issue of assessing the success rate of mediation is not addressed in the literature unambiguously, given the focus of this monograph book on the exercise of mediation in the context of judicial dispute resolution and the nature of the data collected for the spatiotemporal analysis of mediation in the EU countries, we rely on a formal approach to success rate. Therefore, what we understand as success in mediation is the conclusion of a mediation agreement resolving the dispute or a subsequent conclusion of a court settlement. This final chapter, given its specific character, will also have a different approach than the previous sections. This is because this chapter itself will draw conclusions and formulate prospects for further development of mediation on the basis of the previous parts of the book.
