Czech Republic National Report on Criminalisation of AI-Related Offences

  • Original language description

The article represents a national report, which has been chosen among some others for a special monotopical issue of the RIDP dedicated to the new challenges that the rapid development of AI poses for the substantive criminal law. The monoissue was prepared in the course of the preparations for the Section II "Crimes in the Criminal Code" of the 21st congress of the International Association for Penal Law, which will take place in June 2024 in Paris on the occasion of the centenial of the establishment of the AIDP and which shall focus on the overarchig topic of "Criminal Justice and Artificial Intelligence". The article presents a thorough analysis of the current state-of-play of the AI legal regulation, academic research and policies in the Czech Republic, the readiness of the current concepts of Czech Criminal Code for tackling emerging new problems related to AI from the perspective of both a tool for possible criminal activities as well as an object of protection by criminal law. It mixes the descriptive analysis of the current approaches with contemplations about possible development in the future.
