    Role of Consumer Welfare Standard in Broader EU Competition Enforcement Perspective

    This article examines the role of competition law in addressing the challenges posed by the digital economy and other dynamic economic sectors. It compares the EU and US approaches to the consumer welfare standard. It argues that the US standard, which is traditionally based on monitoring price and output, may be considered insufficient for regulating the digital economy, which has led to a shift towards protecting market structures. In contrast, the broader and more flexible interpretation of consumer welfare in the EU may better reflect the complexity of digital and other dynamic markets. The article emphasizes that one of the pressing issues for the EU lies in its procedural mechanisms for enforcing competition law, rather than in the consumer welfare standard itself. Examples from recent competition cases.
