    Constitutional Conventions in Central Europe: When Two Are Doing the Same It Is Not Always the Same

  • Original language description

    The aim of this chapter is thus to explore whether there are any differences between the individual Czechia and Hungary cases concerning constitutional conventions, and if so, what explains these differences and what repercussions these differences have for the legal and political life of these countries. It shows that there are actually significant differences between these two countries. Czechia has embraced constitutional conventions – albeit in relatively few areas – and the Constitutional Court, as well as the Supreme Administrative Court, found some of them justiciable and even decisive for the outcome of some cases. In contrast, Hungary has so far resisted justiciability, as well as a thorough discussion of constitutional conventions.
