New Concept of Support, Protection and Empowerment of Vulnerable Adults in Czechia
Original language description
Human life is related to vulnerability, which is expressed by the general thesis of the vulnerability of a human being - a child, a person with a disability, an elderly person - but also a person in various family or social roles. In addition to this general thesis, the doctrine also refers to the concept of special vulnerability, for example, for refugees or members of minorities, regardless of age or possible health handicaps. Previously, the law focused its attention on the protection of vulnerable persons. However, this paternalistic paradigm is now being complemented by the requirement to strengthen respect for the autonomy of a persons ́ will and to support them. It should be emphasised that, in the light of this new view, the Czech Civil Code provides vulnerable persons with both protection and space for the dignified expression of their will and guarantees that this will be respected both by the courts and, above all, by close family members. The new approach to the issue strengthens the natural rights of human beings in the broadest sense of the word, but also (and especially) emphasises their right to family life, closeness, happiness, joy and dignity in general.
