Original language description

The prevention and remedying of environmental damage should be implemented through the Directive 2004/35/CE of the European Parliament and of the Council on environmental liability with regard to the prevention and remedying of environmental damage. Thedirective is based on furtherance of the polluter pays" principle. The fundamental principle of this Directive should therefore be that an operator whose activity has caused the environmental damage or the imminent threat of such damage is to be held financially liable, in order to induce operators to adopt measures and develop practices to minimize the risks of environmental damage so that their exposure to financial liabilities is reduced.

Evropská rada schválila v roce 2004 směrnici O odpovědnosti za životní prostředí v souvislosti s prevencí a nápravou škod na životním prostředí s cílem zavést společný rámec pro prevenci a nápravu škod na životním prostředí. Obecně evropské směrnice jakosoučást sekundárního práva EU zavazují členské země dosáhnout určitých cílů během implementační lhůty, přičemž národní instituce mohou určit prostředky, jak těchto cílů dosáhnout. Co je ovšem důležité, je právě dodržení implementační lhůty, která v případě směrnice 2004/35/ES uplynula 30. 4. 2007. Tento článek má ukázat, jak se s transpozicí jednotlivé členské státy EU vyrovnali, a podrobně popsat situaci na Slovensku a v Česku.
