Copyright in the Czech Republic is based on Article 34 of the Charter of Fundamental Rights and Freedoms. This article recapitulates the views on the concept of this regulation - in relation to the EU constitutional law and international conventions. The article also proves that it is not just a proclamatory provision, but it is also used in the decision-making practice of the Constitutional Court of the Czech Republic. During these decisions there is compared conflict of the constitutional protection of the results of creative intellectual activity with other constitutional rights, in particular with the right to freedom of expression, the right to a fair trial, and the right to protection of property in general.
