European constitutional polycentrism guaranteeing the protection of human rights and freedoms
Original language description
The European Convention for the Protection of Human Rights and Fundamental Freedoms is a core document of the Council of Europe system. Its jurisdictional application by the European Court of Human Rights directly affects the constitutional systems of the member states of the Council of Europe. Due to its nature and influence on constitutional systems, the Convention has thus become a certain European human rights constitution. Its essence is the binding concept of basic human rights as natural rights, but also some political and economic rights. It is also important that the Convention is a concept of their judicial procedural enforceability in the member states, based on the original concept of the right to a fair trial.
