Original language description

The procedure for resolving collective labour disputes is governed by Act No. 2/1991 Coll., on collective bargaining. The Act provides that collective disputes are disputes concerning the conclusion of a collective agreement or disputes about the fulfilment of commitments in a collective agreement that do not establish claims for individual employees. As far as collective agreements are concerned, whether they be enterprise-level collective agreements (ELCAs) of higher-level collective agreements (HLCAs), they usually define a specific procedure to be taken by the parties to prevent disputes arising, and in some cases set rules regarding cooperation when such disputes are being resolved.

Czech description

Postup při řešení kolektivních pracovních sporů upravuje zákon č. 2/1991 Sb., o kolektivním vyjednávání. Kolektivní spory podle tohoto zákona jsou spory o uzavření kolektivní smlouvy a spory o plnění závazků kolektivní smlouvy, ze kterých nevznikají nároky jednotlivým zaměstnancům. Pokud jde o kolektivní smlouvy, ať už podnikové kolektivní smlouvy (PKS) nebo kolektivní smlouvy vyššího stupně (KSVS), obvykle vymezují konkrétní postup smluvních stran pro předcházení sporům, případně stanoví pravidla vzájemné spolupráce při řešení těchto sporů.
