This article aims to analyze the causes of bankruptcy and the impact of the financial crisis on the corporate insolvency´s evolution and the changes in the Czech republic regime. There is needed to create the procedure regulating the exit of companies from the economy and improve its insolvency law and save viable businesses and to stimulace the creation of new ones. Less willing to risk opening a small business may mean changing bankruptcy codes, which could create stagnation in our economy. Clear causes of bankruptcy are drawn between failures in management, marketing and financial aspects. We want to compare the Czech republic position to European Union in term of time and recovery rate and dynamics of business insolvencies´number and to propose specific measures to improve its situation.
