    The international responsibility of the North Atlantic Treaty Organization - do ARIO represent an effective tool?

  • Original language description

    This chapter focuses on the determination of the international responsibility of the North Atlantic Treaty Organization (NATO) in the light of the Articles on Responsibility of International Organizations (ARIO) developed by the International Law Commission. NATO is an international organization and therefore a subject of international law that can bear international responsibility. The chapter evaluates the practical applicability of the ARIO in light of NATO’s specificities in its legal and institutional setting, including NATO’s specific decision-making process in which NATO member States retain more control than probably in any other IO. After validating that NATO possesses international legal personality, the chapter focuses on the determination of an internationally wrongful act that is attributable to NATO. The chapter concludes that in the case of NATO, it would be challenging to establish its international responsibility under the ARIO; partly due to NATO’s considerable peculiarities and partly due to the ARIO’s deficiencies.
