Gaudium et Spes: Between Pastoral Character and Prescriptive Obligatoriety
Original language description
In the promulgatory apostolic constitution of the Code of Canon Law, Pope John Paul II states that the Code is inspired particularly by the both constitutions of the Second Vatican Council, that is, the Dogmatic Constitution Lumen Gentium and the Pastoral Constitution Gaudium et Spes. The latter constitution is not in itself conceived as a source for inspiring legal norms. However, we can find certain support for the future canonical regulation. In particular, this regards the deepening of the concept of Marriage, which inspired the Code with its new determination of the ends of Marriage, and the new ordering of the relations between the state and the Church, on the basis of which the concordat law has been developing in the period after the Council.
