Legality and Legitimacy of the Autonomous Weapon Systems
Original language description
Presentation focuses on legality and legitimacy of the the autonomous weapon systems. From this point of view, neither international treaty, nor State customs imposes explicit ban on AWS. On the other hand, these weapons also establish legal gaps in process of control and attribu-tion. Arising key question also arising is also whether the AWS would function in a way that respects the obligation to distinguish military and civilian objects and per-sons and also other types of protected people. Legitimacy of AWS is based on premises considering reduction of casualties on the side which deploy this kind of weapon system; and diminish the influence of negative aspects or imperfection in human nature. On the other hand, AWS also represent threat of dehumanization of armed conflict. Worst scenarios in this case warn against possible uprising of AWS and conflict their former creators.
