SELECTED ISSUES FROM CZECH LEGAL REGULATION OF LAND PROPERTY

  • Original language description

The legal concept of ownership in the Czech civil law has changed several times over. The modern Czech legal regulation of civil law began with the Austrian General Civil Code from 1811 (ABGB). This code and its principle had keep force until 1950. In 1951 had come in effect the Civil Code, the Act.141/1950 Sb., based on some principles known from the Soviet Union especially on difference among private, state and personal ownership. Also the objects of ownership and transfer of ownership were regarded different from the past legal regulation. The causes of these changes were political interests. Political changes in 1989 have led to the principle and permanent changing of legislative in the past 16 years. These changes have touched ownership, as a legal title, above all. However we are still waiting important changes in the new Civil Code. The code is being prepared 10 years over, and the works are not finished yet.*
