Arbitration is usually defined as a manner of dispute resolution. A dispute is brought forward for binding resolution by one or more persons, the arbitrators. The following are the defining elements of arbitration: (i) exclusion of court competency of general courts in flavour of arbitrators, (ii) independence and impartiality of arbitrators, (iii) competency of arbitrators to make a final decision in re (arbitral award), which is endowed with enforceability.
