    Informed and Free Consent as a Tool to Process Personal Data by General Data Protection Regulation in the European Union

    Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR) comes into force since 25th May 2018. This regulation exchanges the present Act No. 101/2000 Coll. on personal data protection and implements totally new rules for this issue in the EU member states. Many subjects do not realize that the regulation is valid in all member states beginning with an effective date and that it is not the subject of implementation into national legislation. Also this fact is said to be the reason why the GDPR regulation is being discussed but only few subjects makes the needed steps. The aim of this article is to mention and analyze possibilities when the subject can process personal data as well as to show that the only consent is not always the easiest or the most suitable way to process personal data. On the contrary, it is the latest option if the subject does not find any other legal basis to process the data. Subjects&apos; agreement being not properly used is misleading and groundless since the beginning because it can rather make things worse for the controller or processor contrary to assumptions.
