Original language description
The paper deals with the legal liability in subsidy law, which is an integral part of financial law in the Czech Republic. The starting point of the research is the subsidy legal relationship and its entities who in some situations may be liable for the infringement. The aim of the paper is to identify possible problems related to legal liability of entities in subsidy legal relationships and to suggest possible improvement of the current situation. The research methods used in the paper are analysis and synthesis, description and comparative methods. The paper primarily derives information from in force and effective acts, existing case law of the Supreme Administrative Court or of the European Court of Justice. In conclusion, thanks to the relevant case law and the many amendments to the relevant acts (especially Act. No. 218/2000 Coll.) the legal certainty has been strengthened in the area of not yet very clear interpretation of (not only) legal liability in subsidy relationships.
