Original language description
The transaction of international trade also brings with it the possibility of misunderstandings and costly disputes, unless purchase contracts are thoroughly concluded. Incoterms help manage these risks. The main purpose of the Incoterms rules is to define mutual roles, duties, responsibilities, and the transfer of risks. The aim of the article is to identify the benefits of Incoterms conditions in concluding purchase contracts. The authors conclude that the use of Incoterms clauses brings more advantages than disadvantages. Both for individual contracting parties and for international trade. An important aspect, however, is the correct use of a suitable condition. The authors also draw attention to possible impacts under inappropriately used conditions, such as ineffective risk allocation or abuse of a dominant position.
