Original language description
Legal protection of children in the past can be divided into two separate areas: paternal authority and guardianship protection of orphans (guardianship authority). Paternal authority was seen as a summary of special privileges that belonged to the headof the family, pater familias, in relation to his wife, children and other descendants in the male line. Guardianship was defined as a protection and power over a person who was incapable, due to his immaturity, of defending and protecting himself. The main task of the article is to describe the key principles of the legal protection of children in the Czech lands in the past and compare the content of the Allgemeines Bürgliches Gezetzbuch from 1811 with the previous legal codes valid in this territorybefore the end of eighteenth century, both of the systems of municipal law and the land law.
