Original language description
The chapter deals with the question of the position and attitude of the Czech Constitutional Court in connection with the tool of preliminary question. Author analyzes the question whether CCC is the "court" in the meaning of so called Wasssen criteria established by the CJEU. After positive answer the author focuses on the analysis of the practical experience = real cases where CCC dealt with the question, whether commence preliminary ruling procedure or not. In the end of the chapter author discuss the question whether there is a need of participation of constitutional judiciary within the preliminary questions procedure and analyzes the pros and cons of the submission of the references.
