Original language description
The concept of affirmative action originated in the United States in 1961 and since then has been used in this country to promote equal rights of minorities in numerous fields, especially employment, education and federal contract compliance. The Court of Justice of the European Union defined the concept of positive action particularly in cases connected with equal treatment of women in the access to employment. Both in the United States and in the European Union affirmative/positive action presents a hotly debated topic, therefore this paper intends to introduce the most problematic issues relating to this area, especially with regard to the case-law of the Supreme Court of the United States and the Court of Justice of the European Union.
