    Preventing Major-Accident Hazards in Spatial Planning

  • Original language description

    Spatial planning is an important instrument of management of major- accident hazards. Since 1996 the so-called Seveso II Directive (Council Directive 96/82/EC on the control of major accident hazards) regulated also the role of spatial planning and stated that the EU Member States were supposed to ensure that the objectives of preventing major accidents and limiting the consequences of such accidents are taken into account in their land-use policies and/or other relevant policies. The newly adopted Seveso III Directive (Directive 2012/18/EU on the control of major-accident hazards involving dangerous substances) imposes new obligations of the EU Member States concerning the spatial planning. The author focues in her paper on the role of spatial planning in the system of control and management of major-accident hazards and analyzes Art. 13 of the Seveso III Directive in the light of the ECJ case law.
